Three Tips for Getting the Best Personal Injury Settlement

Personal injury cases are usually resolved through what is referred to as a settlement. Since personal injury is basically a case in which a person suffers a bodily injury as the result of someone else’s negligence, the resolution of the incident is usually the responsible party paying the injured party a sum of money to reimburse him or her for injury and losses. Between 95% and 96% of personal injury cases are settled this way, but it doesn’t mean that the injured party always get the settlement they deserve. Here are three tips if you’re looking for the best injury settlement.

1. Document Everything.
The first thing you need to do to ensure that you get the best personal injury settlement possible is to make sure that you document everything you can about the injury and your losses. This means take pictures of the scene of the accident and of your injuries as soon as you can. Additionally, make sure that all of your injuries and the accident are reported to and documented by the proper authorities. Then make sure that you keep track of and document all of your losses.

2. Hire a Lawyer.
Another thing you should do if you’re looking for the best injury settlement is hire a lawyer. In the few cases that do actually become personal injury lawsuits, plaintiffs in those cases only win 50% of the time. This means that if you aren’t happy with the settlement that the responsible party’s liability insurer offers you, you might wind up in court — where you’re going to need legal counsel and representation.

3. Negotiate.
If you aren’t happy with an initial settlement offer — and chances are you won’t be — you need to negotiate. This is another reason that having legal counsel is so beneficial during a personal injury case. Lawyers have experience negotiating with insurance companies and will know precedents for similar cases. Make sure that you have all of your documentation when you’re making negotiations.
