Silica Exposure Attorneys in Charleston

Silica, or silicon dioxide, is a chemical compound found primarily in building materials, like sand and rock. When this compound is crushed, hammered, moved, or otherwise handled with great force, it can release fine silica dust into the air, exposing nearby workers and residents to toxic crystalline silica.

Construction workers, factory employees, contractors, or nearby residents exposed to silica dust may be at serious risk of developing Silicosis and other damaging respiratory conditions, including lung cancer. In such situations, the injured parties may be eligible to file personal injury lawsuits against the companies or individuals responsible for their injuries.

Who is at Risk of Silica Exposure?

Silica dust exposure can happen in a wide variety of environments, including manufacturing facilities that work with cement, asphalt, brick, ceramic, household abrasives, adhesives, paints, soaps, glass, and steel. When ground down, broken, or manipulated, these materials can release the toxic dust, endangering factory workers and anyone else nearby.

According to the Occupational Safety & Health Administration (OSHA):

“The most severe exposures to crystalline silica result from abrasive blasting, which is done to clean and smooth irregularities from molds, jewelry, and foundry castings, finish tombstones, etch or frost glass, or remove paint, oils, rust, or dirt form objects needing to be repainted or treated.”

OSHA also claims that nearly 2 million workers in the United States are currently in danger of silica dust exposure, 100,000 of which are involved n especially high-risk jobs, like stonecutting or quarry work.

Holding Negligent Parties Accountable for Silica Injuries

Although OSHA has taken several steps to help protect workers from dangerously high exposure to crystalline silica, some companies disregard these restrictions, putting their employees, and others, in harm’s way. The Permissible Exposure Limit limits the amount of silica workers can be lawfully exposed to, and the National Emphasis Program for Crystalline Silica helps regulators identify and eliminate health hazards associated with silica exposure. Additionally, employers are required to inform workers of the potential hazard associated with silica exposure, and they must provide respiratory protection.

If an employer fails to uphold these safety measures, or if they do not provide employees with the appropriate training or equipment, they could be liable for the resulting damage. Silica dust is a human lung carcinogen, which means it can result in the development of certain cancers, along with other illnesses.

Silica dust exposure can result in the following illnesses and injuries:

  • Lung cancer
  • Silicosis
  • Lung infections
  • Tuberculosis
  • Breathing problems
  • Scar tissue in the lungs

Do You Have a Case? We Can Help.

We understand how difficult it is to deal with respiratory injuries, and the physical pain can become even more poignant if you are also contending with the fact that your illness could have been prevented. If the liable party had warned you about the potential side effects of silica dust inhalation, or if they’d provided you with proper safety equipment to prevent exposure, you may have been able to avoid the resulting damage.
