About IVC Filter Defects
The manufacturer for IVC filters, C.R. Bard and Cook Medical, first gained FDA approval for the sale of their device to U.S. markets in 2003. Shortly thereafter, patients began reporting serious issues and fatalities in relation to the device. In 2015, NBC News took ahold of the IVC filter issue and claimed that C.R. Bard and Cook Medical knew their IVC filters had a higher failure rate than competing devices as early as 2004, when they conducted a private study. However, this information was distributed only to executives and was completely hidden from the public.
In 2015, nearly a decade later, the FDA issued a warning to the CEO of C.R. Bard and Cook Medical, confirming that the company did fail to report information about the dangerous aspects of their device. That same year, IVC filters were linked to 39 reported deaths.
What Type of Damage Can IVC Filters Cause?
Because of their design and structure, IVC filters can migrate through the Inferior Vena Cava, moving to other organs causing various types of damage. If the device fractures or breaks, it can cut or perforate nearby tissues, or it may break and travel to the heart, lungs, and other organs, causing life-threatening complications. The device can also result in blood clots, the very danger they are designed to prevent.
IVC Filter Lawsuits: Taking Legal Action
As of July 2019, more than 14,000 lawsuits have been filed against IVC filter makers, including C.R. Bard and Cook Medical. Several individuals have won jury trials against the IVC filter manufacturers, and some have settled outside of court to cover various expenses related to the device. Compensation for an IVC filter lawsuit may include medical costs, future medical expenses, loss of wages, pain and suffering, and more.
In the event that you lost a loved one to an IVC filter, our firm can help you file a wrongful death lawsuit on your spouse or family member’s behalf, which can also include compensation for funeral and burial expenses and loss of companionship. Our goal is to handle the legalities of your case so you and your family can focus on healing and grieving.
