Understanding the Dual-Ended Earplug Defects
3M Company and its predecessor, Aearo Technologies, Inc., created and sold the dual-ended Combat Arms Earplug, Version 2, to the United States Military. The dual-ended earplugs were designed with two separate functions—when worn on one end, they were intended to block all sound, and when flipped, they were designed to block only louder noises. However, due to a design flaw, the earplugs were too short, which caused them to loosen imperceptibly while in use.
As a result, the earplugs would slip out of place, rendering soldiers vulnerable to the damaging sounds of gunfire, explosions, and other noisy interferences.
About the 3M Earplug Lawsuit
According to the whistleblower, 3M was well aware of the product flaws, but they chose to hide the earplug’s vulnerabilities in order to preserve their contract with the Armed Forces. Unfortunately, their irresponsible actions left countless soldiers vulnerable to damaging hearing injuries. In July 2018, 3M agreed to settle the lawsuit with the federal government for breaking the False Claims Act. As a result, the company agreed to pay $9.1 million.
