What Is a Traumatic Brain Injury?
The medical definition of a TBI is a brain injury that resulted from either (a) a violent blow to the head or body that caused the brain to slam against the skull or (b) an object, like a bullet, puncturing the brain. A TBI can be mild, moderate, or severe. Even mild TBIs (mTBIs), or concussions, can seriously impair brain function and impact your life, however.
Concussion symptoms may include but are not limited to:
- Loss of consciousness for a few seconds to a minute
- Feeling dazed and confused
- Speech issues
- Sensitivity to light and/or sound
- Memory problems
- Difficulty concentrating
Moderate to severe TBI symptoms may seem like exacerbated concussion symptoms, such as:
- Loss of consciousness for minutes to hours
- Profound confusion
- Worsening or persistent headaches
- Difficulty waking up
- Slurred speech
Components of a Traumatic Brain Injury Case
In St. Louis, you can only recover compensation for your TBI if you can prove the following elements of your case:
- The other party owed you a duty of care;
- They failed to fulfill that duty by committing negligence;
- The negligence led to an accident; and
- The accident caused you injury and to incur damages.
All TBI cases must prove these four elements, no matter the cause. For instance, a person who sustained a TBI in a car accident would need to prove that the other driver owed them a duty of care, which they did if they were on the road. Then, they would need to prove that the driver was negligent, such as by texting and driving or speeding. Next, they would have to show that the driver’s negligence caused an accident and thus their brain injury.
Similarly, if a medical professional caused a person’s TBI, that person would need to prove the existence of a doctor-patient relationship (duty of care), then that this medical professional violated that duty by negligently acting against or below industry standards. Again, the person would then need to prove that this directly caused their TBI.
